Ticket: Not Eligible for Traff. School?
I'm pissed. Just got my ticket in the mail...says I'm not eligible for traffic school. None of these apply? Maddening.

The violation(s) on your ticket must be eligible. Any violation that carries a negligent operator point count of more than one point is not eligible. Seat belt, mechanical or equipment violations, failure to have insurance and other certain specified violations are not eligible for Traffic School.

You may not have attended Traffic School in the last 18 month period.

Your ticket must not have defaulted to a failure to appear.
*
Your ticket must not be for a violation of Vehicle Code Section 22406, which prohibits any motortruck or truck tractor, a passenger vehicle or bus towing another vehicle, a school bus transporting pupils, a farm labor vehicle transporting passengers, a vehicle transporting explosives or a trailer bus from exceeding a maximum speed of 55 miles per hour on any highway.

I'm pretty certain that that would fall into the zone where the judge may have some discretion in allowing traffic school, although I always had it in my mind that >15 over posted means no, several others have posted here that they were able to do traffic school after being cited for as much as 20 over.
But I'd second the advice from TurnWRX, throw yourself on the mercy of the court, and plead very nicely and respectfully that you'd really like to be allowed take traffic school.

So, do I even go in there with a defense, or just say that I learned my lesson with the monetary wrist slapping (it's hard for a kid in school to come up with $$$) and would appreciate the court's consideration in allowing traffic school?
I still don't understand why they are not allowing traffic school in the first place...

My speeding ticket said that. It didn't even let me pay the fine if I wanted to. It said I had to go to court. When I went to court I plead guility the judge lowered my fine and told me I could take traffic school. Btw I got my ticket in Redwood city on 101S for doing 97 at 3am.

I really didn't say much they just asked me if I wanted to plead gulity I said yes. Judge lowered the fine to $150 and told me I could sign-up for traffic school.

one way that you can get out of ur ticket is to set a court date and cancel it on the last day possible, then set another court date and cancel it again, keep doing it and eventually (after 6 or 7) times, when you go in the cop will not show up so you do not get the ticket. they get tired of you making dates and cancelling so eventually they stop showing up. its worked for me once before and i got a stop sign ticket today so hopefully itll work again. good luck on gettin ur shlt cleared

This is exactly why I fight tickets. Traffic citations are primarily given for revenue generation, under the 'guise' of public safety.
I fight almost every ticket I get, and can guarantee you that the city loses money every time they write me a ticket. As an inefficient bureaucracy, I somehow doubt they are actually doing any P&L evaluations, nor increasing the number of citations due to increasing costs to prosecute them.
Saying you shouldn't fight the government when they try to take your money because it will cause higher taxes is ludicrous.

You can go to traffic school... you just need to request it at court. Depending on the county, the judge may left you.
I went to traffic school for 103 in a 65 and got it pulled from my record.

The thing is...I'm out of school the 22nd, and I plan on going back to WA immeadiately after. My court date isn't until the 28th...should I do a written dec. or are my chances better at court?
