As I was driving home today, a police officer pulls into my lane out of nowhere. I thought he was going to pull over a bimmer infront of me that was going way faster than I was. but for some reason, he stops, looks at me, and then signals me to pull over. As I am being pulled over he looks at me and tells me I was speeding and my exhaust is illegal. So now I am stuck with a CVC 22350 and CVC 27151 (a) violation in Cali. Meaning that I was supposibly speeding and have an exhaust that violates the sound restrictions in CA. How do I fight this ticket, because I feel that I did not do anything wrong...
Go to the ref and have them sound test it, if you are under the legal limit, the fixit ticket is done with, as far as speeding: http://www.ticketassassin.com

Thats the thing, for once I was not speeding. Thats why this ticket has me soo pissed. Full story; Im going down a 3 lane intersection, and a bimmer infront of me was speeding. Im behind him about 50 feet, and then crosses a speed trap. Cop on bike pulls out and starts signaling the bimmer to pull over. While doing this, hes goes into the center lane, where I am. Looks at me, then tells me to pull over. Then proceeds to give me a speeding ticket and a fix it ticket for my exhaust, which happnes to be an apexi, which Im pretty sure is carb legal and what not.

yes even if say the guy in front of you is doing 80mph and you are behind him doing 75mph the officer will most likely will stop you and ticket you. They do that all the time. It is considered dangerous for them to go around and get the next faster car. So they get the person in front of them which happened to be you.
Keep in mimd because you were passed by someone going faster that does not mean that person will get ticketed if both of you are speeding. They will ticket the person that they first see speeding or doing something illegal.
Good luck
Nick

Its an apexi RS exhaust, but what Im not sure of is if it is legal. I think it is compared to every other exhaust out there. The only thing different about it is the size, it does not make any loud noises that would be considered "illegal", its quite silent.

Yup you can either fight by written declaration. Ticket assasin I have heard that gves good ideas for the write up. Now if you did not have any tickets for the last 18 months you can go to traffic school (depending how much above the speed limit you were going).
By the way was the exhaust cat back or TBE?
Do a search in the southern CA forum and it seems lots of folks have gotten through this. If it is just a cat back go test it out. If it is less than 95 db you are home free. I think they even give you 2 more db's so up to 97 they let you off. then they put a sticker on your ticket you take it to the judge and he dismisses the ticket. I would suggest put the OEM exhaust on have the ticket fixed. then ask them to "test" the other exhaust. If it passes keep the certificate handy. Now if it is more than catback (catless, TBE etc). I have heard rumors that for the "loud exhaust ticket" they only check the db's. They do not care if it is TBE or something. But if they do check it, scratch this off. You must be totally stock. By the way they also pop the hood as well. So if you have anything aftermarket like an intake etc they will fail you. The referee knows what the stock car emission equipment looks like. When they plug your car in a schematic comes up. They are much more knowledgable and strict than a smog station.
cheers

Im in San Jose, and yea, got ticketed for 66 in a 45. Im going to go with the ticket Assassin and hope that gets me out of the bs speeding ticket. As for the exhaust, Im hoping to go to some asian shops and get it tested, hopefully they can help me out, if you know what I mean.

He stopped you because he saw more that he could write you up for... and 66 in a 45, good luck with that one. Got to watch out for those bike cops, they are the ones with the most knowledge and also the ones that you don't see coming....

FYI - Intakes do not automatically make your car fail upon State Ref inspection. I was sent to the referree with an Akimoto intake and Greddy exhaust and all he did was look and run the smog. $45 later, I was out of there. Judge then threw it out in court. There are cars out there that were sold with intakes like the special edition AEM Civic directly from the dealer.

there was someone on NASIOC that replaced his muffler with a straight pipe. He was tested at 97db
I think if you put anything on the end of your exhaust, you should be under the 95db limit.
