dude, its still her fault under CA law, and its hit and run. She forced you out of your lane, and therefor is "at fault". The fact she ran, makes it felony hit and run, call the cops, report it all.

Not true, my mom had a client who avoided a car that had changed lanes without looking, but when they swerved out of the way they hit a parked car. The client was at fault in the eyes of the law.

If I'm going to the guard rail.. I'm taking a piece of your car with me to prove you were at the accident. I got nothing to lose at that point. Just hope to get a angle that pulls your bumper off and your lic plate falls.
