Request continuence?

I am going to court today to try to fight a ticket I got. I am hoping that the cop will not show up. And yes I know I should have done the written declaration trial. But I waited too long.

Anyways, if the cop shows up, can I request a continuence and push the court date further and hope the cop will not show up the next time?

You should be able to. I'm sure the judge will ask you why you are requesting it, so you should have an excuse ready. Maybe you need time to gather more evidence, like a traffic study or something of that nature.

Yup, you'll need a reason for the continuance. Make sure that once you get it, that your 'excuse' is taken care of (e.g., you now have that traffic study).

Damn!

The cop showed up.
I asked for continuence and was denied.

I did not even bother arguing.

Guilty.

From 20 people that were in court today, 4 cases got dismissed because the cops did not show up. Everyone else was found guilty. No ifs no buts. What a money collecting machine the traffic court is.

another collecting machine is the DMV...

when was the last time you went to the DMV and NEVER left without giving them $$$$$... lol.......

Why would they give a continuance after the cop has already showed up??? That's crazy.

If you think you'll probably lose in court, I recommend getting postponenments prior to submitting a plea, then doing a written declaration. If you lose, you still get to request a court appearance (Trial de Novo or something I think).

How will the cop remember you if he cited you a year prior to the date of offense? Plus, tickets only stay on your record for 37months FROM THE OFFENSE, not the court date, so push out the court date as far as possible in case you lose.

so you could ask for continuance the first time you show up to the courthouse to find out what time to come back, but not in the first trial itself? would they need an excuse for this too? dont you have to ask for trial by written declaration? ive never gone to traffic court so i dunno! i just got a ticket too...
