Question Question for LEO's

Lets say that I was carrying a shotgun in my car.
Are shells in a side saddle considered "firing position" or is that legal unloaded storage as a long gun?

And no, I'm not talking about carrying a shotgun in the car all of the time, more of a theroretical question

IIRC
ammo & firearm must be seperated and either one must be in a locked container.

BTW, California used to be an "open carry" state.

^+1.

They have to be totally separate, ie: gun in the trunk, ammo in the passenger cabin.

I know that applies to hand guns, but long guns are treated differently in some cases

State law: http://www.ag.ca.gov/firearms/travel.php

Federal law: http://www.cjrpc.org/interstate_1.htm

Hope that helps. When I transport I have a locked ammo box, and a locked gun case.

Interesting, I didn't know that. I think the side saddle may be a grey area and dependent on the cop.

Still is, so long as the weapon is not loaded. Check out the subject on calguns, quite a few people are now carrying openly and have been stopped, questioned, and let go because they are not breaking any laws.

I would think a side saddle would come under the "within reach" rules and be a problem.

Perhaps you should visit http://www.californiaopencarry.org/. Remember, what the government posts on their websites is not always law.

Thaaaat's what I meant earlier; Something about counties with a certain amount of population allow loaded open carry.

Got any info on this?

IIRC, it's ok as long as the population is 5,000 or less.

and dont forget boy and grills...

while you are home, you can be as loaded and and concealed as you want to.

also, in your place of work, if the owner allows it, you can CCW also.

the only exception is if either is within 1000' of a school.
