Pulled over for "110+"

Angry Pulled over for "110+"

Last night I was headed back to Sunnyvale from Half Moon Bay. I was on 280 south and I have my cruise control set at a little over 85mph and I see lights behind me. At this point I'm thinking, "Crap, I'm gonna get a ticket". So I pull over and the CHP says, "You know I pulled you over for your speed.". So I answered "Yes." because I wasn't gonna lie to the cop, I was speeding. This is what made it awesome, he told me I was doing "110 plus" because he had to do 120 to catch up to me, yet he DIDN'T get me on radar. So now I have to appear in court for excessive speeding. There are only a few things I would like to know:

- Can I use my cruise control as evidence?
- I have two witnesses who were constantly checking my speed, can I bring them in?
- Can I still be ticketed even though the officer never had a radar reading?

Any help or links would be greatly appreciated.

well when he said he had to do 120 mph to catch up to you is because he was at a dead stop so youre pace is already going .not sure about the witness but you never know tho so just let them come when you go to court and since the cop that pulled you over is going to be there listen to his story if it gets inconsistent.

You're off the hook. If you were at 110 and he was at 120, it would have taken 2 counties for him to catch up to you. Besides- no pacing, no radar, no ticket.

werd, technically you could have been going 60mph and he could have gone 150mph to catch up to you, it has absolutely no bearing on what speed you were going, just how fast he decided to go to get up to you, what a n00b cop!

Oh yeah... don't forget to ask him in court why he didn't arrest you like he was supposed to when you go 100+. (Hint: the answer is because he didn't catch you going that fast. )

Wouldn't all these occurances of police facking up citations warrant having a tiny video camera with audio pointed out the front fo the car? Maybe recording the most recent 15 minutes of footage on a loop? Maybe even digitally? Now that would be evidence.

most jurisdictions do have them, but don't use them for traffic enforcement.

that sucks, i would just go and be honest to the judge and tell him the whole story and say that u refuse to take anything less

If he paced him, it has to be noted on the citation with some sort of reference.

I wasn't paced, he never had me on radar. He just popped out of nowhere and pulled me over.

just go to court and say this, "not guilty, go ahead try and prove otherwise"

remember he has to prove you were speeding, you dont have to prove you were not. make sure you remind them that in court.
