One weird/crazy night....

And the story begins....
Well tonight we were cleaning the outside of Frys when we see the cops walking a shoplifter from the stores all hand cuffed and such. Found out he was trying to steal a PDA from the store. Then the dudes were getting ready to tow his car. We take a look at it and see its a Green Outback. The car has some Rally Art decals through out the car and on the doors. Anyone know who this is? My friend and I was all telling the cops to let him go but they didn't listen. Then afterwards a few buddies of mine decide to go to IHOP over at Mercado. We're at the light when a silver z28 camaro comes up next to us thinking they're going to get in front of us. We both launch our cars and make the turn onto the street and take one more turn. Then a cop comes and guess who he pulls over? Me!!! He talks to me and says that he's guessing i'm going 50mph and that he wasn't using a radar gun. I was telling him I was just going 35 and I have my 4 friends to back me up on that. Then he says that i'm just kidding myself. He calls for backup or something and another car comes. They talk for like 5 minutes and they call me out of the car to come and talk to them near their car. My one friend who looks black stepped out of the car and the two cops started yelling at him and one of the cops looks like he was about to push him in cause he was reaching for him. My friend gets in the car and I start talking to them. We started talking and the cops buddy was all telling the cop who pulled me over, "should i call the tow truck now or later?" and he just says "hold up". Then freakin he was telling me why i'm racing. The whole time I kept on saying that i'm not racing that i'm just moving alone quick so I dont get cut off. Then he's all, "tell me the truth or else i'm going to call the tow truck and impound if for 30 days, lock you up, and make your friends walk home". And I just kept telling him I wasn't racing that I just launched quick so wouldn't be pulled over. Then again he's all telling me that he's going to get my car towed and such. I continue to tell him again that I wasn't racing. Then after a while the dudes just told me I'd get a warning and that i'm lucky. My friends were saying how the cops were trying to get me to admit that I was racing. They told me they were going to search Mercado for the silver camaro but eh. Then I went to IHOP and ate 3 out of the 5 pancakes and then went home. Oh I saw a Blue WRX leaving IHOP too.

Quick question....
Could I refuse to come out of the car if the cop asks me to?
I'd like my friends next to me if they're talking to me as witnesses for stuff the cops and I say.

your friend wasnt too smart when he came out of the car. cops dont really like that b/c they dont know what that person is up to. you pretty much have to listen to cops when they pull you over or they will act quickly. sucks that they gave you so much crap over launching your car.

Ya, stay in the car with the keys out of the ignition with your hands on the wheel. And when talking to the officer, say "yes officer" "Im sorry officer" or expect a shalacking

If you launched from a standstill with the intention of staying in front of the other guy, that's a speed contest or street racing.

I know someone that drives like that all the time. He even drives that way with his wife and kids in the car! Fortunately, he doesn't have anything with real power so acceleration is pretty lackluster. He still puts others at risk, though.

Nope.

And it was the definition of street racing- you launched hard to keep someone else from getting to point B before you.

We were just saying that cause he drives a Subaru like us. Weren't really serious about it since is how he did try to jack a pretty expensive PDA.

I just picked him up from the gym and he was wearing his shorts and wife beater. Pretty dumb though since my other friend told him not to while my other friend dared him to. He was just "testing" the cop. The cop told me to take control of him and I did.

I didn't really launch the car hard. Its slower then the type of launch at the track but faster then you'd normally do. I'm pretty sure I just hit 40. But eh it was a launch.

Your friends wont' make good witnesses because you guys are personal friends. It could EASILY be argued that you all cooberated your stories in an effort to stay out of trouble.

No you didn't have to admit you were racing. In fact, if a cop is every trying to get you admit anything (in refence to your driving), deny it. I had a cop try that on me once (although unlike you I actually wasn't racing). He had stopped me and a friend and tried teling me my friend had said we were racing and why was I lying?!?! so I just told him my friend would be an idiot if he admitted to racing since we weren't. Generally, when it comes to crimes like speeding or even reckless, the officer has to actually witness you breaking the law or he can't do a thing. Even if some concerned citizen contacts the police from the freeway.

And I don't think you can refuse to exit your car. You can refuse search/seizure (up until the point they have a warrant to do so). If you refuse to exit your car, I think that one way or the other you'll be getting out - whether the cop has to rip you from the car or other

this was all before i had license, i had to get out of the car, hands on the hood but when he asked to search me i said no, and refused to let him, he had no real reason to, so he did not serach me

Don't race, tell your friends to respect the law, and take the two pancakes home with you next time you don't eat them all.
