GREENBRAE, Calif. (KGO) -- There was a dramatic shootout following a burglary in the North Bay Wednesday when a 90-year-old retired law enforcement officer defended his home against an intruder.

It happened in broad daylight in the 300 block of Via Le Cumbre in Greenbrae. The suspect forced his way into the house and was met by 90-year-old Jay Leone, a retired law enforcement agent who confronted him, shooting him three times. The suspect then shot Leone once.

Police found the suspect wounded inside a black Lexus on Tiburon Blvd less than a mile from the home he tried to burglarize. He had called 9-1-1 saying he accidentally shot himself. Police say the suspect, who has a long criminal history, has been identified as 30-year-old Samuel Cutrufelli of either Novato or Petaluma.

"During this interrupted residential burglary, we believe the resident of the house managed to shoot the suspect who entered the house, multiple times," explained Sgt. Mike Norton of the Twin Cities Police Department. "And then, the suspect actually returned fire shooting the resident one time."
Sara Navon lives in a unit below Leone. She was at home when she heard two big bangs then ran upstairs to see what was going on.

"I looked at the front door, from the inside, and I saw a chair trying to block the entrance," she recalled. "So, I knew that something's wrong here and I need to get out of here."

Both Leone and the suspect were taken to Marin General Hospital and are in stable condition. According to police, they did not know each other and the incident was completely random. Police say Cutrufelli will be charged with burglary and attempted murder.

Many wonder how an elderly man managed to confront a burglar. Less-surprised neighbors told ABC7 Leone is incredibly fit and very agile.
You think this old man would have survived the robbery if he wasn't armed?

-While guy is collecting goods old man gets his gun

-Old man shoots robber

-Old man gets shot in the FACE.


Does it really not occur to you that the robber was not expecting the 90 year old man to put up a fight, and would have left without harming him at all if not fired upon?

I think gun control is idiotic, but so is saying having a gun did this guy any good.

you logic is flawed. fact is he entered the home with a gun. the punishment is directly related to him having the gun,fired or not. hes a known felon with a past and entered the home with a gun. having seen this in person i know for a fact the robber would do whats needed to not get caught. i have no doubt at a minimum a pistol whipping would have taken place.

he has the right to defend himeself by ANY means. guns are NOT the problem here,the 2 striker thats not in prison because of overcrowding IS the problem.

So many times we have read in the papers how old people are targets. They get beat,scared robbed.... Its also very traumatic experience for anyone let alone a older person. Glad someone made the bad guy a target. And a felon with 2 strikes and a gun is almost always a guy that is not going back or at least not easily.

I can't believe you guys are praising him for that, you should be bashing.... He shoulda killed that Thief! Then celebrate!

Ok ok I'm kidding, I'm glad the old man shot the damn burglar. Serves him right.

I own guns and love to go sports shoothing (I don't hunt) but the whole issue would not happen if we had a more strict gun controle. Then again the guy that broke into the would have a gun anyways because the law does not mean sh*t to anyone these days

I like this story much better in support of guns rights...

Okla. Woman Shoots, Kills Intruder: 911 Operators Say It's OK to Shoot

2 break in and threaten a woman with a knife, 1 dead, 1 escaped and faces felony and possibly murder charges (there was a follow-up in the news somewhere). I doubt this 18 year old mom had much chances to protect self and a baby without having a gun

The guy is an old veteran, I don't think we know that the robber would definitely shoot him either. Anyways I said him having a gun did his old *** no good here since he got shot in the face. He shoulda sneaked it out and shot the guy in the dome to start.

If this happen more often maybe people would stop robb'n. But so far California has taken all the legal gun owners rights away. So the bad guy knows he has a much better chance.

I hope never to get robbed.. I'll yell at them to get out and if that doesn't work or I see a gun.. I know for damn sure its always better to have one side of the story and not a second.
