No matter how this turns out, I think the owner is pretty dumb to pursue charges. Everyone will now know his restaurant by name and he pressed charges against a customer. I don't think anyone will like to go there anymore. But well, this is the States, and maybe more people will actually go and hope to get charged... haha...
gdogg and 04wag.... my thoughts exactly. My family owned a restaurant before and I have worked in customer services jobs and there will be good and bad customers. They had pizza and say some booze. what is that a 150 - 200 bill and they left less than 10%.... ahhh they're crying over 10-15 bucks. and now we in Cali know of this place. pretty poor business sense to me.

You guys all seem to be missing thje point that they didn't press charges because of the money, but because the customers were such a-holes about it.
Minimum gratuity for large parties is how resteraunts make sure that they don't lose revenue from smaller tables that can tun over more dinners in a given time than a large party usually will.
But if you have a gripe about the food or the service, you should take it to management in a civilized manner, every restraunt I've ever worked at will go out of their way to make an effort to appease a dissatisfied custemer, provided they act like grownups.
But being abrasive and rude isn't going to win any points, especially if they treated the staff that way during dinner.
From my reading of it, I'd say these customers had it coming.
At the same time I'll admit that I left only 10% last night at Chevys, we ordered two regular sized margeritas, my regular sized one showed up with my dates Super grande, no biggie there, but I also asked for water.
Then when we ran out of chips and salsa, the guy took the salsa cup and didn't bring any back, leaving the basket with chip crumbs on our table the rest of the night.
My queadillas showed up, but our table didn't have any utensils, and still no water.
I ate my dinner with my fingers, which was OK for about half of it, but it got kinda messy with the Habanero/Mango slasa on the last few pieces, especially since the only napkin was the little square that came under the marg.
So we got our $28 tab, never saw water on our table, never saw napkins, forks or knives, and still with a basket of chip crumbs.
My date threw in $10, I had two twenty's and a one, I put down a twenty and a one, and we left.
Even though I didn't do much complaining, I hope our waiter learned something from it, but in retrospect I might have been a bit more forceful.

you all have a good point but only to a certain point. There is a huge portion of society that tips extremely poorly. My GF was a waitress at Chilis in HI. During the Pro Bowl Seahawks O-lineman Walter Jones came in. He had a bill in excess of 800 dollars. He left a 10 dollar tip. This guy makes over 6mil a year and he tipped her 10 bucks. But on the flip side Bryant young came in and had dinner for two and tipped her 50 bucks. That automatic gratuity is there for the protection of the servers cause people will definetly try some sneaky **** when their in large groups.

that's some horse pucky man. I left a 17 cent tip once with my room mate because the service...WAS that bad. It was the worst i've ever had...I was raised by a waitress....I tip really well. generally 17% to start then up to 25%.
forcing someone to tip is rediculous... these servers are suppose to give good service. No service no money.

psoper....that statement on how the people were acting is purely one sides opinion against another's. And beyond that...if you are getting really ****ty service you have a right to say something. Who really knows if they were being dicks or not...or if the wait staff was or not. That's the thing with something like that..it's a stupid law. Waste of tax dollars. Good thing they aren't mine or I'd be pissed.
bay area places with the worst service hands down....Chevy's. Dave and Busters.
I've had bad service other places..but it's constant ant both those places...and it's at all chevy's. It was chevy's that we left a 17cent tip. I just left like a 12% tip at DB's because the help was so bad. The management at those places is not good.
but for the most part I am very patient and very nice...even to the bad ones. But that's just me. I don't think it's wrong to question why you are getting bad service.
I was at chilli's a while back in fremont...long while back. years. we were getting horrible service so I said something..nothing rude. Just like...I don't know why you picked us to serve poorly but it's not a good way to make a living. The table next to us....guy leans over and tells me...hey. I heard what you said. Lets talk. Turns out he is the new head honcho at that location and always goes and eats at places before he comes in to meet the staff...to see how people work when the big man's not in. The girl got fired....she gave his table horrible service as well. Honestly can't remember if it was a girl or guy server at this point but I'll never forget feeling sorry for them when the big man came in the next day.

Honestly, if you're so stupid to not realize that tip is included on a large party, you're probably just an ***. This is New York City we're talking about, most people living in that city have a clue. If the service is really that poor, the proper course of action is to discuss it with the manager/owner in a rational manner. You will be compensated in terms of not paying your tip or free food more often than not.
