LOOOOOOOOOONG day...
Got here at 9am this morning... I'm still here.
So that's... 13 hours so far. No breaks. Had someone grab me a sandwhich for lunch but that's all I've had all day. No breakfast. No dinner. My dinner has consisted of swiping some animal crackers through a jar of PB I had in my desk. Woot.
So I figure I'll be here til' 12. That puts me home at 1am.
I then I have to get up at 6:30. Go to my 8:30 dentist apt. Then start another day that could very well go to this hour.
And the kicker....
I don't get paid O.T.... but I'm not on salery???
figure that one out.

as far as I know if you're salary they have to pay you for a complete work week even if you work as little as a couple hours. But you don't get paid for extra hours. So there's usually a trade off. Like if you work mad hours they let you cut out early or what not on another day.
Now if you're not salary it's my understanding that you have to get overtime.
I was under the understanding that I was salary.. no O.T.
Then they cut my hours and I wasn't getting paid the full week so I was like... O.K. WTF.
So it's about time for me and the bosses to have another talk.
Though I do think they're letting me cut out early on friday so I can roll up with you.

If you're not exempt (salary, maybe some other positions qualify) you get time and a half anything more than 8 hours and less than 12, and double time for anything over 12. Also, anything more than 40 hours in a 7 day work week (7 day work week is a set 7 day period as defined by your schedule) and 7 days in a row if it falls in that 7 pre-defined 7 day work week is overtime.
That whole 7 consecutive days thing has screwed me over before though. My work week starts on Monday, so I have to work Monday through Sunday to get overtime for 7 days, but I've worked Tuesday through the next Saturday which was 12 days, but none of the 12 days completed a Monday through Sunday work week so I saw no overtime

FLSA is pretty clear on overtime. If you are a nonexempt employee(hourly) anything over 40hrs per week or 8hrs per day. That is something that should be set by the employer. If it is not clear you have a case for compensation. Example: I schedule my guys for 40 hrs per week. The work 12 hrs per day. Three 12s, one 4hr shift per week. They swap every other week and work an 8hr shift. This gives them three 12s + one 8= 4hrs OT every other week. One week they work Four days. The other they work three. They're stoked about it. It's fair and in compliance with the FLSA and CSU pay structure.
