Legal question (aka I got a ticket)

So my watch read 8:31, his read 8:24. Carpool ends at 8:30 and I had just pulled into the lane. He looked like he was just going to warn me but went back and wrote up the ticket anyways. Looked like it was a hard decision for him.

Can I fight it?

there is a good possibility that you can win this in court. as long as yout told the cop and showed him that your watch did indeed say 8:30 something when he got up too your car. just set a date, and if you want to be sneaky, call and move it as close to the date as possible, and then go on the second date. you might get lucky and have him not show up!

I'm hoping I can prove my case to the judge. $271 over the matter of 6 minutes (according to his watch) is ridiculous.

Ask the judge to throw it out "in the spirit of the law", if it comes down to a court date and the CHP shows.

Yeah this sounds pretty winnable to me. Was this cop a jerk or something? You know how most cops will give you a 5MPH leeway? You'd think the same for carpool lanes... but because watches can be off more than speedometers for the avg car ride, I'd hope for a 10 min leeway. Man, how weenie, esp if you showed him your watch.

I must have passed all of 8 cars before he pulled in behind me too. Like I said, it looked like he was having difficulty deciding what to do. He actually tried to chat with me about my commute afterwards. Like I really wanted to be buddy-buddy with the guy after that....

Did he write down the time on the ticket? I say treat it like a radar ticketand ask the last time his watch was calibrated and ask for proof if it isnt thrown out right away. Then ask the cop about his commute after.

I say you deserve the ticket. I know you changed the time on your watch while the cop was walking up to your car. I know the truth and I'm gonna testify against you. muhahahahaha

I didnt have to. My watch is always set 5 minutes fast.

u'll never get away from the CHPs, if u get pulled over by one, u r definitely gettin a ticket, at least PDs will let u go once in a while...good luck with ur ticket, itll all depend on the judge whether to throw it out or not, just hope the judge is havin a good day that day

I'm sure you can fight it.. Who's to say that his watch isn't 6 minutes early... Is his watch set to the atomic clock? I highly doubt it, and it is definitely fightable.
