1) too big of a car to fit in that parking
2) not know how to park your car

Hide, the fact you said the driver first argued with the Officer, then said you hurt his morale implies an admission of guilt, therefore by law the Officer has the admission and HAS TO TAKE THE REPORT to file on your behalf.

FWIW next time you start seeing that sort of behavior going down from the person who hit you, and if you don't have a dash-cam, pull out your damned smart phone, subtly switch it to video, and place it speaker up in a shirt or front pants pocket to record the audio.

A judge will call the audio inadmissible because there was no consent to the recording but when coupled with the two things above, arguing with the officer and a passive admission of guilt the judge or insurance will side with you.

Basically make use of the steps to set a preponderence of substantiating evidence.



So, if you get nothing out of that except one thing, it's that it's spelled M O R A L E.

Too small a pic to read, but likely an expired insurance card.

That said, pull that image down off the internet right now because at this point you're hurting any case you have against the guy because he can then cry foul on you.

You have your insurance to goto with this stuff, and slide as a consultant, and some of us as further consult's.

Don't blow any chance you have on recouping a loss because you're still mad and openly ranting and disclosing his info.

Funny though he does have a Commercial license and this will hurt him. At that point he should've just owned up to the Cop. There are ways to privately have handled this by simply having the officer wait with you and the vehicle and making a walk over to the nearest bank teller machine.

WRONG... Department policy can dictate when a police officer may or may not take a report.

This was a misdemeanor that did not occur in anyone's presence. Even if the driver admitted he hit it and left, he is there now and didn't have to be hunted down. He provided his info.

You took your photos. Hopefully you took more than those two (like scene shots, both license plates, how they're parked within the lines, maybe even one of him! etc...). If he's the owner of the truck it's his responsibility to pay out and his insurance will. If he has no insurance, sue him! Take him to small claims, and if he refuses to pay, force him to show up and show why he can't pay. Hopefully YOUR insurance will do that for you though.

So DDMan, does your department let you go to an accident scene, where a driver is uninsured, and not write a ticket (also known as a report) let alone an accident report when one is requested by P2?

BTW, that SO has a policy to take the report.

^Yep, same point I was making. Hopefully Heedz at least has the RO's badge # or business card and can contact and request a report be filed in light of the evidence in hand without having to be a jerk about things. It should be a simple thing to get San Mateo County Sheriff's Dept to help ya out, professional courtesies aside.

Heedz, FWIW, I'll remind you I had the same b.s. happen with the RO from the Sheriff's Dept in Santa Clara. It took me contacting the attorney from the other deal to get it handled. Luckily my representation was still on retainer so I had to pay nothing for him to scare that department's RO into doing his job.


*Either way it has to show up in dispatches call and activity log.* Fill out the public info request and if that fails write a letter and get your insurance to co-sign it. Within the letter mention you are willing to pursue a subpoena of the records to verify if they are complete or not. Don't be surprised to find like I did that your phone log records do not match the report filing's red date stamp. Also don't be surprised if the other parties personal info is Red-Acted, even tough you clearly have an image of it all.
