HELP with car accident

HELP with car accident
ok so lucky that it wasnt my car that got into an accident but it was my cousin who got hit from the passenger side by a older model gmc yukon or a tahoe. he was driving out of his apartment going stragiht towards the exit when the suv pulled out of a parking spot and t-boned my cousin in his integra. after about an hour of talking to the insurance company and calling the cops, we get no where. the guy is from mexico, only has a mexico id, no ca drivers lisence or any lisence at all, insurance has been expired on the suv for a month already and the SJPD says they cant do anything about the accident. so now my cousin calls his insurance company to see how the damage would get repaired as it needs a new quarter panel, new door and rear bumper. what can we do to get this guy? we were thinking about pursuing to sue this guy but we dont know how to approach it.
any help will be appreciated.

well its kind of late to call the sjpd AGAIN... when my cousin called the sjpd the first time, they wouldnt come out to see the accident nor send any help and all they siad was they couldnt do anything about the accident.

bump for new information.
my cousin just called me and told me that the insurance is sending over someone to estimate the damage on the car. but my cousin wants to know who will pay for the damage, will it be my cousin, the driver of the car, the owner of the car or the insurance company

we dotn give a crap about how poor he is. he should have never been driving without a lisence or insurance anyways. and on top of that hes not even a citizen of the united states. insurance is contacting the owner of the car now. and hopfulyl that stupid **** who drove the car gets deported.

Man I know that pain. Noted, I did not have someone without insurance hit me but I know the pain.
Listen, as long as your cuz has uninsured motorist coverage he can sit back and drink a beer. If he does not, it may get a little odd but I hardly doubt the police or his insurance company will find him at fault.
In some cases they will split at fault, but the great thing about insurance is the company will fight tooth and nail for him unless he is 110% not at fault, regardless they will fight.
Anyhow, all he needs to do is contact his adjuster and the adjuster will go over all the deets with him. They deal with this everyday so make sure he makes sure they stay on top. At times it will seem like things are not moving at all, be sure he knows this is part of the game as well. That **** drove me nuts when I was dealing with my accident.
Naturally you want answers now; you want to know what is next, and what to do to help. It’s natural so just tell him to chill a bit and let the company deal its processes and get things going. However, make sure they do not slip. A call every other day is not asking too much. I used to set up status calls with my adjuster. Sure, she prob hated my *** but you know what? I PAY FOR THIS COVERAGE AND OVERALL SERVICE. So **** being shy, make sure he feels all comfy. lol
Anyhow, best of luck to him. I know it is a ****ty ordeal but in the end I hope all works out for him.

Well that may happen. I know insurance companies will sue people to recoup their loses. Additionally, the other party can sue to recoup losses. however, chances are you will not get a cent which again is why we all should be covered with uninsured motorist coverage.
Wow what a pain in the ***... I bet if you or I were caught driving without a license or insurance there would be "something they could do about it" then...
I was seen when I bumped a curb near my house by San Carlos PD, and they followed me home, and wrote me up for 1) hit and run (WTF, over?), 2) fleeing the scene of an accident, 3)"unsafe turning movement" and 4) filed an accident report stating bodily injury on my behalf even though there was $96 worth of damage and obviously there was no bodily injury (tire still had pressure, drove home). Yet they tell you over the phone that there is nothing they can do about this un-licensed/un-insured illegal alien that just slammed into your car...
A friend got rear-ended in San Mateo, called 911 and was also told to just file a report as there was nothing they could do... I cannot recall a time not just from my own life but AT ALL where a cop, police officer or CHP did something good or at least useful. You would think it happens, and if it happens you would think we would hear about it but... No. Sorry to hear. What a load of crap.

Well all the cop could have done is arrest him and book him. Then guess what? Release him.. Most cops are prob going to say F' it, no need for paper work if that dude is to walk hours later. It is the ****ty truth but thats the game.

They should arrest this illegal for driving without a license & driving without insurance then let bubba and the boys take care of him for a few weeks while they prepare the papers to deport his ***.
Makes me feel like a fool for spending $7K and 2 years legally getting a green card and legally running my cars.
Saying that though, I wouls miss my burritos if I couldn't get one tomorrow.
