Iirc the cop doesn't have to show you the radar upon request, and I would imagine the cop who drives without lights on may turn **** if you did. Jourdan what's was the violation code on your ticket?

However, there is something about them having to be visible with parking lights on.
Oh, and wikipedia/wiktionary are not reliable reference sources, espcially with legal issues where wording of the law is key.

Was it a Monterey PD or CHP? And if it was a CHP was it a skinny black guy? If so I've dealt with him before and he is a flat out ***.Did he pace you at night? Isn't that a safety issue? If it was something you feel strongly about, you could have consulted one of rhode lawyers that deals specifically with traffic violations.

Was he parked under a light? Sometimes they use that technique around here. BTW, I believe the "speed trap" defense MIGHT work here - although it depends on his range when he tapped his brake lights. I believe that in order for it not to be considered a speed trap, he has to be visible for 200' in one direction.

they set up trap parties..there was over 5 cars i saw in a few miles distance pulled over..so i slowed down to 65-70 mph at a 65 limit..still got pulled over for 68..fu**en jackass

it used to be they HAD to have lights on...i dont know the exact ruling anymore but lets be honest with ourselves, cops dont really play fair

I'll look up the vioation code later today as I am at work right now.
I'm thinking that I'm just going to pay it, hopefully I am eligable to traffic school.
He could have had his headlights off to check to see if any rear lights were out when he came up on you, I was pulled over for that once. Cop pulled up behind me, turned off his headlights, and pulled me over for my plate light being out. Ticket was dismissed though because the cop didn't state whether my plate was visible from 50ft w/o lights. Unfortunately that's not the main reason you were pulled over lol...

its definatly not entrapment. you sped by him.
entrapment would be....... a cop told you its ok to do doughnuts. then he gives you a ticket and tows your car for 23103 (reckless driving)

u should try a trail by written declaration. You have nothing to lose by doing so. Go to www.ticketassassin.com, there is tons of information on how to fight a ticket and templates for ur written dec. If that doesn't get you acquitted, you can opt for a trail de novo and get a shot in court. Police in California get paid incentives for appearing in court but not for writing a rebuttal, which would be required of them in a trail by written dec. So many are acquitted simply for the fact the officer didn't have time/or didn't want to spend time writing a rebuttal. Also, considering the time of night and the flow of traffic, I think you have a good shot. Whatever you do, do not just pay the ticket, it is your right to contest any citation and you have nothing to lose by doing so. Try it, it worked for me. Read up, and good luck!!
