Yup call the Police and forward the guys phone number and info. You never know he could of done this before. Either way if paypal was used he would never see his money back if he claimed it. Only way you get money back from PP is to wait for the person to have money transferred into their account. I also think PP offers insurance that would refund you automatically if you make a claim like this? GL

I say contact the police first. A similar situation happened to me while I was at school in Davis. I contacted the local PD and they were able to get the issue resolved. However, much more recently, I was scammed through Craigslist (part I received was not what was listed) and the local PD (Alameda County) was much more unwilling to lift a finger. They suggested small claims court.
I would contact your local PD and also try the police department where the other guy resides. I'm sure if the officers are willing to help, a simple phone call from the police department will make him change his mind about trying to scam your friend. At the very least, see if they're willing to tell you which penal code/civil code violations are at issue, i.e. what laws has the guy broken.
If, however, the police are unwilling, or for whatever reason are unable, to help, then small claims court may be your friend's best option. This of course depends on how far your friend lives from the other guy. If they're on opposite sides of the country it probably wouldn't be worth the trouble. However, if they are local or within reasonable distance, I would consider filing in small claims court an option. Often times, for most small disputes, the filing fee is about $30. There are no lawyers involved. All you do is get your evidence together, and show up and argue your case.
Before doing this, however, you may want to have your friend write a "demand letter" and send it to the other guy. Generally it's just a letter that outlines what took place, what you want to receive (i.e. your money), and why they should give it to you. You can even cite and laws to support your argument. Then you can attach whatever documentary evidence you have to show him that you have everything with regards to this transaction documented. Mail this to him via certified mail. Hopefully that will light a fire under him.
In any case, I'd highly suggest making .pdf's of whatever documentation your friend has in regards to this transaction. This includes the eBay auction page (hurry up as these things expire), scanning whatever receipts from Western Union he has, and also making .pdf's of any emails that may have been sent back and forth. Go to CutePDF.com for a free and small (size-wise) .pdf creator.
