no. as i said the regulation in the OP is refering to using a non-oem as a replacment wich is fine. but you cannot change the location to a FMIC that falls under modified emissions.

.
no where in that listing say the LOCATION of an IC...

all they specified is OEM turbo.

i know i know... wording... but that's how technicalities came about.

granted it might take $$$$ to prove it in court.

but hey... at least you got something in writing from the state.

afterall, only reason FMIC are "illegal" for subarus are due to the front bumper beam that needs to be hacked in order for the piping to fit.

mitsu designed theirs for a FM in the start.

plus, when you look at it, what part of the emission system does the IC affect. nothing. hence the preamble to that section G, about all necessary emissions parts to in place in the first place.

all the components involved in the act of a ICE contribute to emissions. the intercooler increases the intake charge density therefore more fuel and air will head to the combustion chamber, more fuel means more CO and HC=increased emissions.

mitsu FMIC is stock oem wich makes it completely legal.if fmic was oem on subaru then swapping out the core would not be an issue.

the bumper beam issue is a DOT subject. an fmic alters the bpv position, and modifes vaccum line location wich is illegal and falls under appendix-b (b-2) modified.

this is the way the states see's it
this not a personal opinion of mine,im just telling you how they see it and untill that changes its a moot point.

the refs have some upcomming updates, with turbo ID guides, alot can and do spot aftermarket turbo's allready,so your rolling the dice.

by law as a smog tech or a ref is required to remove plastic engine covers,if you make a cover we remove it or you will have to. some techs in the field will risk thier careers by being lazy and not removing them.
Yeah but still =p The more OEM things look the better.

thats why you take the state to court and make them either shut up or rewrite the laws...

My hoses even my fuel rail hoses have a carb number on it. So I'm safe there.

Now I'll add a EVO IIXVI'I To my cars back trunk lid and call it a day. I'll be 100% legal.

I was once asked few years back when getting a ticket what my car was... So I think I could pull that off...

a front mount intercooler IS an intercooler, the line states that intercoolers are allowed. The mention of OEM is for the turbo said intercooler is attached to.

Nice thing about the engine cover... Is if some cop is looking they might not see. If they dont see. I dont care about the state ref... I think thats the point we are all missing. Something has had to happen to get you to the state ref. Fool that person and you dont have to deal with the ref. Engine cover is a great idea.

If you have a FMIC or an aftermarket TMIC you can use this stencil to make it appear legit and oem. http://cgi.ebay.com/ebaymotors/ws/eB...3AIT&viewitem=
If anyone's interested, just shoot me a PM, and I hook you local guys and gals up for free.
I have been making these for years, and they come out nice if you do it right.
