When slamming your car, make sure you dial in a bit of camber -

can't tell if you're being sarcastic or not - damn interwebs. the post description was my failed attempt to be funny.

i got t-boned @ the intersection of San Tomas and Stevens Creek. I was coming up on the inner left turn lane slowing down for the red. A lady (female - go figure right?) was half cocked in the outside left turn lane.

i saw her sittin pretty all cocked diagonally and since she was stopped and did not continue to move forward to the clear inside turn lane, my assumption (i know, my mistake) was that she was going to stay in her lane.

the light turned green so i began to accelerate and just as i pass her, she guns it right into my car. she obviously did not look out for oncoming cars and once it turned green, she took that as her chance to get into my lane. funny thing was that she hit near the rear of the car so she musta've seen 1/2 of my car in front of her before she hit me - bad reaction time i guess.

no one was injured though i had to get towed. that tire was scraping as i pulled off to the side. she basically blamed it on me saying that the guy behind her "waived her in" and she took it as an indication of "all clear."

sucks to see this happen when i haven't even broken 10k miles. to add insult to injury, i just finished picking up my CF wrapped CS style lip and got a car wash.

yea i was being sarcastic, I figured you would be posting up what happened soon enough, that sucks though. BUt it doesnt seen like the car will be down for too long

Well that stinks. Hope she is insured! Did you file a police report? When ever I am in an accident I ALWAYS file a police report.

no i didn't. am i fcked?

i have photos of her damage, my damage, her plates/drivers lic./ins card. called ins. right away to file a claim but they didn't mention anything about filing a police report.

You do not have to get one and no you are not fracked. It just makes it easier to win a dispute in fault, if there is one.

That is definitely more than $500 damage, which means it needs to be reported in CA. Pretty much no accident that involves paint damage will ever be less than $500.

You won't get in trouble like you are going to get a ticket or anything, but you should go file the report.

Make sure to file it in the right city too - San Jose or Santa Clara? Depends on which side of Stevens Creek it was on. Guess why I know that? Not sure about at that intersection, may all be SJ, but better to make sure.

PD reports makes everything easier. It has with the three accidents I've been in where I'm 0% at fault

thanks for the input guys. i'll stop by the highway patrol office today to file a counter report. hopefully things goes smoothly and i'm back on the road soon. i was looking forward to getting my Enkei Raijins in this week - oh well.

Are you going through insurance or out of pocket? If your going through your insurance you might as well file one, couldn't hurt.

Sounds like a clear case of the other person NOT being aware of her surroundings. I was the victim of a case like this before.

I easily won my case so I don't think you'll have issues with yours. Just make sure you tell the insurance that the other person was clearly not looking before she made the turn.

going through insurance.

the ins. co told me that i would need to have an estimate done by one of their shops but can go to any shop i choose to have the actual repairs done. my questions are:

- they say they guarantee their shop's work. wouldn't any reputable shop guarantee their work?
- besides the "guarantee," are there any other pros/cons vs going with their shop or choosing my own?
- any southbay body shops you gents can recommend?
- how the heck are they gonna fix that qtr panel? looks a bit mangled to pop out back to normal...

btw the paint on the car flakes off like my pasty skin a week after a bad sunburn. the wind was strong enough to start blowin' pieces off. this can't be normal right? further evidence that our paint sucks *****?

You should not have to take it anywhere to get an estimate. They should send someone out to where the car is. To get the work done go with a shop you know and trust. I prefer Yeaman Auto Body in Palo Alto. When I had insurance work done there the insurance company's estimate was about a grand short. Yeaman said "Don't worry about it we work it all out with the other insurance company and you don't need to pay any more than your deductible."

I don't think they will try to repair that quarter panel they will replace it. Cut out the bad part and replace it with new sheet metal.
