CA Law makers trying to overturn results of Prop 8!

CA Law makers trying to overturn results of Prop 8!

I was just watching CNN:

Apparently law makers are trying to overturn the results of prop 8 because they want equality, and they claim that CA voters cannot make such a big change to a state law.

Sorry, I dont have a link, but thats pretty much what they said verbatim.


First off, this is the second time the people voted against it and won. The first time around it was overturned which is total BS, whats the point of even having a democracy if the people can't vote and win on an issue that the majority wants to have changed?

I don't give a rats *** if a gay couple wants to be married, more power to them, but if the majority of people voted against it, not once, but TWICE, well then I'm sorry.

Before anyone jumps in and says "How would you feel if the majority of folks voted to ban guns?"... Gun ownership is specifically protected in the constitution, if they tried to ban guns all over the US there would be a massive revolt and the USA would no longer be the USA... Sorry for the hijack at the end there...


PS: I posted this in BAIC because it's a CA specific issue and not many people venture into the politics forum

The 9th amendment says that rights not explicit in the constitution "shall not be construed to deny or disparage others retained by the people"



so that response IS very appropriate- what would you say if a majority voted YOUR rights away?


Oh and that revolt is going to go over really well, like you think you can take on a division of the US army with your closet full of pea-shooters?

Not to diss your collection Daniel, but I think they have some considerably badder weapons than even you do....

I really think that the notion that guns in the hands of citizens being any protection from tyranny pretty much ended with the Civil War

The point is, it treats one class of citizens different than another. Think about that, especialy when it affects people like...well, me.

The people of CA have said "Overbear, you are a second class citizen that does not deserve any civil rights"

I voted no on 8. But I vote almost every single election, the funny part about this is that young, liberal people that I know... many of them didn't vote. It was this excuse and that excuse. When we start talking about prop 8, they start saying how can it not pass, blah blah blah.

Ah may be it's because you didn't vote.

I was talking to my wife before the elections and told her I think 8 will pass. She looked at me and said no way, we live in CA. Well yes, but with Obama running, and all the money and the churches' influence, prop 8 stands a very strong chance of winning.

Question, if you post No on 8, did you actually go out and vote against 8? If not you are part of the reason why it passed and shouldn't say a word about it.

Yeah, I totally see what you're saying and I too think it's wrong for them to not have that right, my only point is WHY EVEN HAVE AN ELECTION or something if they are just going to overturn it anyway? Not once, but TWICE!

Its not a democracy if we can't vote and stick with it... That is my only gripe.








I probably shouldn't have posted this thread, but I couldn't help it, it totally made me fly off the handle.

In case you missed it, I voted AGAINST 8 (for gay marriage)

I think the problem here is, both times it has directly violated someones rights. This isn't a simple law, it is one that directly prohibits a class of people from doing something the rest of the people get the right to do.

and I never suggested you voted yes, the little time I got to know you in person, you struck me as a very intelligent, and fair minded guy.

I hear what you are sayin Brucelee, and it seems the reason people voted yes is because that was the majority of what the US feels is right, but keep in mind that the majority is not always right nor do they act in the interest of human rights.

By legal channels Prop 8 passed and is law. And by legal channels one group of people, who disagree with the outcome, are trying to get it overturned.

This is the system. So I don't see what the problem is either way.

I honestly think some people were confused when they were voting. I was talking to people and they seemed to think that if you support gay marriage, you vote yes...YES for gay marriage. But that's not the case...

it hink we are just outnumbered... religious and ethnic people... which is maybe why it didnt pass...

i got stuff in the mail frm like asian community groups that said say yes on 8... then there are soo many churches out there ... im sure it just outnumbers people who believe in equality

I Agree that lawmakers cannot overturn the will of the people, but the courts can overturn the will of the people, that's why they are there, to interpret law. If this wasn't the case many of us who are not white would only have 3/5's a vote and have to drink from different water fountains and have to attend different schools, and also eat in different parts of a restaurant. So I think the protests should stop, the lawmakers should stop, and the CA supreme court should look at this amendment, and I'm sure they will find it unequal, which it is, and that's about that.

I don't like that they are going against peoples votes, but I understand what they are trying to say. If the 'no' on 8 crowd had actually tried and gone out there all over the state and fought for their rights, the voting would've been different. I saw tons of 'yes' on 8 folks everywhere, but never any 'no' on 8 people out there.

There were a lot of no on 8 people out with signs and everything....

In places like Berkeley and SF where it failed like it should have.

But once you got out of these radical "gay haven" areas, the yes on 8 stuff went pretty much without any counterpoint- like out in the central valley there were tons of yes on 8 signs and posters, but out there, no on 8 was nowhere to be seen.
