but they are trying to tax labor

The budget battle is heating up, and the sales tax on auto repair labor is still part of the Governor's budget. We need you to contact the Governor and Legislators now to let them know that it is unfair to extend the sales tax to a small, select group of services which include, in addition to auto repair, appliance and furniture repair, veterinary services, and that targeting a few industries will affect them disproportionately. The proposal would become effective March 1, 2009.
Tell the Governor and Legislature that if tax increases are necessary, they should be broad-based and apply across the board.
Join with our allies in the Automotive Aftermarket Industry and the California Chamber of Commerce in opposing this unfair tax. We've included both talking points and sample letters on the front page of the ASCCA website, www.ascca.com.
Sales Tax Opposition Talking Points
The following points will assist you in writing or calling to express your opposition. Please feel free to add your personal experience.
A new sales tax on labor will:
* Have a disproportionately greater impact on low-income individuals, whose older cars come in for repair more frequently. High-income individuals, whose cars are newer, more reliable and generally under warranty, will not be subject to this tax increase.
* Add to the cost of automotive repair, providing a disincentive to the consumer to have his/her car repaired. Typically, the cost of labor is approximately 55%-60% of the total invoice. For instance, car owners in Los Angeles County will pay an additional 10.25% on repair labor. In certain Los Angeles cities, they'll pay even more. El Monte customers will pay an additional 10.75%, and in Pico Rivera and South Gate, they will pay 11.25% more for car repair labor.
* Hurt small business owners who are already feeling the effects of the economic downturn through fewer customers.
* Create an economic disincentive for motorists to engage in regular maintenance/repairs. Higher costs come at a time of tough choices by California families. Household budgets are already strained meeting the necessities (mortgage, credit cards, food, fuel and essential services). Making auto repair more expensive keeps it a low priority for many families.
* Challenge the effectiveness of clean air programs like the Smog Check program. This tax increase will have negative impacts on policies established by the State of California regarding clean air and climate change initiatives - the Bureau of Automotive Repair, Air Resources Board and California Energy Commission all tout the importance of properly maintaining a vehicle to promote healthy air through healthy vehicles.
* Unfairly target a small set of services, including auto repair, furniture and appliance repair, golf and veterinary services. If taxing services and/or labor is an appropriate policy goal, it should be extended to all such services and/or labor, including attorneys, accountants, physicians, etc.

thats funny. I know a shop in the bay area that was ALREADY taxing on labor. you mean to tell me that was erroneous and unlawful?
