any experience with officer soto on Hwy 84?

got a ticket from him tonight for speeding.

Does he reply to trial by written declarations? Any experiences?

yeah drive slow or buy a radar detector.

was it just west of sunol right as you are entering niles canyon?

they sit there at least 3 nights a week hiding in the shadows with their radar on. never speed through that area.

I JUST got my ticket dismissed in that dark straighaway of highway 84 ... was doing 65 in that 45 section and was cited by officer Soto.

I did a trail by written declaration and used the ticketassassin.com or whatever....supposedly that VC is the easiest one to beat. How fast were you going?

BTW, Soto is pretty cool for a cop...at least when he cited me he seemed cool.

I have a Passport 8500 X50 but it wasn't in the car. D'oh. Wasn't driving the Sti.

Apparently, I was doing 63mph in the 45.

yeah, right before the Sunol turnoff to Foothill road, just west of main street at the straightaway before the stopsign (maybe half a mile).

I hate when they lurk in shadows like that.

It's like...hey that's cheating!!!! haaa.

I nearly got popped on this one section of highway 4. You come around a corner and there is a passing section. I know the road well so I time it and pass people right there...cop was chillin right there. I seriously told myself if I get a ticket there I'm gonna tell the cop that....

Hey no fair..you cheated!!!

cops up there are either VERY cool or VERY big aholes.


Do the written deal. If it doesn't work oh well. Better to try and fail that to give the government more free money.

By the way, I've beat an 88 in a 65 ticket by declaration as well, so 20 over isn't some myserious or magic number.

You should never mention the speed... because you are actually being cited for violating a specific vehicle code, not a specific speed.

22350:
The Basic Speed Law, CVC 22350 states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of the highway, and in no event at a speed which endangers the safety of persons or property."

I basically stated that the road was deserted so there was no persons or property to endanger.

nice! i just got CVC 22350 also! it was in medium traffic on a one lane road with cars in front and behind me, so i could have been going fastAr than anyone else. also the cop can attest to the fact that the guy behind me was tailing me. would i just say i was going the speed of traffic, even though you recommend not to mention speed?

Not sure on that one... he may say he is "selectively enforcing" the law. I'll usually ask the officer what the maximum safe speed is, or at what speed he does not cite traffic at...i.e. 5 or 10 over. If you are only 2 mph over what the cop says is safe, you could argue that indeed the speed was reasonable and safe for the conditions.

I might use the radar evidence argument in your case, because it's not legal for him/her to use the radar evidence from another car against you (you said you had cars ahead and behind you). And always request a current road survey if you are nailed by radar... if not submitted they may toss the case against you.

So this is the guy that gave me a tinted front windows fix it ticket.
He was not so cool when he did that.
