They can just say, "we are losing money so we cut the bonus, we then had to let him go because we were still losing money."
I am just playing devils advocate and I think that it sucks you were bait and switched.
Confront him about it in a very nice way and record the conversation.
Also I'm sure if you have testimony from 10 other employee's about the bonus issue they won't even bother trying to play hard ball. Right now they are probably seeing if anyone has the ***** to stand up against it.
If that doesn't work just start loosening upper managements oil filters 1 day a time.

Go into a meeting, and tell your boss that you want to record the conversation. If he says no, then stop the recording. At least you have that, which in court could prove to a commissioner, judge, or jury that he had something to hide.

Essentially the only ground he has to stand on is the contract he signed. That's the proof.
It depends on how that contract was worded.
If it's worded to support his claims then what I was talking about is proof of sales. A recording of what he has sold in the time he has not been paid the bonus.
The **** sandwich is that it's a job. Sometimes you don't like what's happening but there aren't that many jobs floating around right now. Keep what you have until you find something else.

back in 2001~ worked for an accounting temp agency. I was placed at Safeway Corporate offices in accounts receivable, "3 month temp to perm" $16+ per hour wages.
Here is the kicker, the temp agency offered me OVER THE PHONE an additional bonus of $2 per hour up until my final day working at that position. I made sure to ask them if it was noted in their computer as well.
I worked for the 3 months, exceeding all expectations by a TON, so safeway continued to keep me as a "temp" for a bit longer, which ended up being another 9 or so months. They offered me a perm position, but I declined to find something better. In total, I worked there about 12~ months. (for the temp agency)
When it came down to my additional bonus, the temp agency wanted to change their "wording" of my bonus to only pay me for the initial 3 months, however, they cannot just change their wording at the end of the agreed contract. The wording specifically stated $2 extra per hour until the final day at that position.
I called the california labor board which was in san francisco, went to the appointment they set for me to meet one of their case workers in person at their offices, and they agreed that they temp agency would indeed have to pay me.
Since they act in your defense, they handled it, and a month later I got a fat check.
Not only that, but the labor board got me MORE money.... they said that because the temp agency withheld payment from me, per California law, the agency had to pay me extra $$$ for not paying me on time.

I never signed a contract. I have never signed anything while being at this job besides the W2....I dont have any documents besides my pay slips that won't add up to what my bonus was unless they admitted to paying the $2 bonuses...the only thing I really have is my fellow employees backing everything up.
I didn't sign a contract either.
I worked for a temp agency. they call me on the phone, tell me the job they have for me, then I go do that job.
there is no signing of anything for the job
key point to my story, the labor board took care of the problem and got me my bonus money which was a "verbal contract" via phone

From what I have heard, file a claim with the labor board (because it doesn't hurt) and usually employer will just cough up the money so they don't have to deal with the labor board. But YMMV.

The way it's being treated is an incentive. It's misleading and sucky that it's being pulled but legally I'm pretty sure he can turn it on and off whenever he wants unless it's written down as part of your pay.
It's kind of like my job. I signed a contract for 4 day a week salary. No matter what I get paid for 4 days a week. The 5th day is optional. It sucks for me because when things get busy I'm expected to bust hump. Do what it takes... i.e. free overtime. So one week I can put in 50 plus hours finish all my deadlines... then the next week it goes dry and they take my 5th day away. But legally they can do that because that's the contract I signed.
My advice... keep your head down. Sell a crap load of parts and make that money. Look for another job with another company doing something similar. Get hired. Quit this job.
