Removing cats + emissions in VA

I'm going to be getting a WRX within the next month or so, and while planning mods, I was wondering - will a WRX with an aftermarket up-pipe, and downpipe, with no cats, BUT the third cat is still there, pass emissions? So basically, only one cat is left out of three. I understand it'll throw a CEL, without doing the 'resistor' mod, or getting a chip to cancel it out. I live in Virginia, if that matters. Thanks!

depends where in va ur at. i live in 757...so there is no emission tests. i just get the sticker.
