Angry SJPD jumps in to road with mini stop sign and 'pulls' me over....

this morning on my way to work, 2-3 San Jose PD parked their motor cycles on the sidewalk behind 2 large RVs.
One was standing in front of the RV with a radar gun and a mini red STOP sign.
He claims that I was going 56 in a 35. It was more like 45-50 right after the speed limit dropped from 40 to 35, but that is besides my question.

I want to know if their tactics are legal. there was no sign of police until the cop walked out in to the middle of my lane and held up a small red STOP sign. I almost thought it was some crazy person cause I didn't see a gun at first.


Besides the smart *** remarks I am sure will come up, does anyone have any useful advice on fighting this sort of ticket? I e-mailed Patrick @ Ticketassassin already but am waiting on the answer.

damn, they got you good. I think it's a bs move to hide right next to a speed limit change.

You're gonna have to do the normal ticket assassin thing most likely, and hope for the best.

the officer has to be visable to the driver when your being clocked.
i dont know what the deal is with him being off his bike or out of teh car.

that is common practice in Wisconsin though. they will have one cop standing alone on the side of the road with a radar gun, and he will call in speeders to his squad car buddie 3 blocks down the road.

legally a cop cannot sit on private property, including driveways and churches.. I got out of a ticket with the help of my admin of justice teacher.. fawkin cops.. they have to have their parking lights on too night or day lots of things to argue dunno if they will work tho

I dont read anything about your description that would make it an illegal speed trap.

They were visible, on public property, and got you doing in excess of the limit....

The best way to get out of this ticket, extend the **** out of it. you can call for two extensions, and mail in another extension ... should give u about 9 months or so, and at the end go to court for it. most of the time the officer wont remember you cause it's been so long, so he/she just wont show up to court and you get off the hook. worked for me

If you were going under the limit before the limit change, it might be easier, but since you were speeding before the limit even went down, it won't help your case much.

There is an infamous spot in morgan hill where Monterey rd goes from 50 to 35 and the police sit there and pull over people left and right.
