In the state of CA insurance follows the vehicle and legal owner of the car.

Tickets are the responsibility of the driver.

For $500, you can find out exactly how many launches before the tranny dies.

tickets also go to the car.. I get toll tickets all the time in my sisters car cause its under my name.... but she was driving the car. also from someone who has sold auto insurance, unless he is covered by renters insurance what he is doing is against the law

There is a new law which was passed this year in California which allows private parties to legally rent their cars.

Can you cite the statute or provide a link?

AB 1871 Assembly Bill - CHAPTERED

From here:

But Assembly Bill 1871, which Governor Schwarzenegger signed into law two weeks ago, reclassifies car-sharing for cash as a non-commercial use of one’s car—as long as the annual earnings from this practice do not exceed the cost of owning and operating the vehicle.

Under the new law, a person may offer his car through a formal car-sharing service (like the for-profit ZipCar or the nonprofit City CarShare) and still remain covered by his personal car insurance. The solution is surprisingly simple: when the car is being driven by a car-share renter, the burden of liability insurance shifts to the driver.

Yeah that is definitely where things go into a legal gray area. Of course, with the current IRS mileage rate at $0.555/mile (adds up quickly), plus his insurance, payments, finance costs, etc., he would have a case if he kept things reasonable. I bet it costs a lot to share one's car, or it would seem to cost a lot when presented in front of a judge.
