Finally got a ticket
I was late coming home last night, so I was going slightly over the limit and got busted for 86 in a 65. I know I messed up and got caught, so I'm not whining about it, but I want to get out of it. I'm more than broke right now with no job and just had work done on my car that I owe for. I checked out ticketassasin and other sites, but it seems my case it too clear cut to be fought like that. It was at midnight on a clear dry stretch of the road, and he paced me. He wrote me down for 22349 (a)- going faster than 65 MPH. For the "location of violation" he wrote I-880 N/B from "A" street to Hacienda. I originally thought he wrote down Hacienda instead of Hesperian, where I was pulled over. Then I remembered Hacienda crossed over 880, so today I went and got the distance between A and Hacienda, it was .9 miles. Is that enough distance to pace someone? I think thats my only way out of it, but he wrote down my last name as Mckee-Parfs (should be Mckee-Parks), and my moms name (we have joint-ownership of the car, so it said on the insurance card) as Eilen instead of Ellen. The only other option I can think of is talking to the guy who pulled me over and asking him not to show up for the court appearence so it gets thrown out. Any suggestions or anything is welcome, sorry for the long post. TIA
Ouch...Thats gonna be a tough one...But good luck. i doubt he wouldn't show if you went and asked him to not show up...your best bet is to fight it, and when i fought for my ticket the CHP didn't even show (was a nice guy and he liked my car though

well you say "finally" but you have only been driving for 3-4 years tops. So i won't say that it's finally as in "it took so long to get one" .
Once you get the first, you'ld be suprized how quickly they begin to pile up.

Its my second ticket actually. I got my first a few weeks before I turned 17 for speeding and warned for accesive acceleration. That one probably would have been easy to fight, but was too young and stupid to. This one doesnt seem to be easy to fight, like I said it was 86 in a 25 on a clear road, pretty cut and dry case.
Oh, also last night I was in Fremont and came up to one of the intersections sorta fast (was before the ticket obviously), and it turned yellow, but I knew i was too far away to make the light, so I ended up over the first crosswalk line and a second later the red-light camera flashed. I wasnt looking at the intersection at the moment, but I dont think there were any other cars going through. Would they send the ticket thing for being over the line a little, or wouldnt even bother with it?
And I meant finally as I've been driving very "spirited" and been lucky enough to avoid getting pulled over. If you got a ride from me you'd understand.

The problem with trying to fight the ticket is that you may have to give up your right to go to traffic school. There are strategies for fighting tickets like this (where frankly you have very little chance of winning-- btw I'm a lawyer with substantial knowledge of the vehicle code), but traffic school is probably going to give you the best risk reward calculus.
If you are intent on fighting you want to file a trial by written declaration (you should know that you have to pay the fine to do this). I wouldn't say anything too specific here, just make it long so that Chipper has to spend a lot of time writing out his response (they don't get paid ot for this). You're basically hoping he doesn't respond. If and when you lose, then go to court. When this happened to me it had been 6 months since the ticket and the officer had been transferred so I won. If he does show then you should make sure to cross examine. You want to trap him into saying something that you can prove is wrong. So ask how long he was pacing you and if he says for 2.5 miles bring a map that shows this is wrong. Good luck.

The first few years of driviing a car you are just getting used to what it can / can't do. Once you get around 19 + you begin to realize what YOU can do with thet car and you begin to push it more and more. You may not even realize it but you begin to go faster because your confidence level goes up a few levels. That's when the tickets start coming.

That's what pisses me off about my tickets- 4 out of 5 were BS, I wasn't "pushing the limits" or even "lightly brushing the limits" or hell, even "within shouting distance of the limits." I was on the freakin' highway going between 75-80... just like a good part of the rest of traffic!

Soya- I know I dont have a shot at winning, there isnt much to fight about it. On the ticket, it said it has to be payed in 30 days, so I think they're on to people trying to fight tickets and giving them less time to do so.
I know I was well within my limits dammit! I've gone faster than 86 without a problem at all. They should secretly raise the speed limit at night. Seems like my only hope to get off is if they spell my name wrong, so I'm hoping for that.

VIN # or the license plate # when he wrote the citation.
Go with Soya's advice, unfortunately you would have to come up with the money up front.
You could also ask for an extension of the case before going to court, stating that you need more time to collect evidence for your case. Also, you could hope that by the time it goes to court, the officer has been transferred out of the area like Soya's case (very unlikely).
After following Soya's advice, go to court and plead 'NOT GUILTY' and ask for a jury trial and hope that the local DA would throw that case out because of cost for them to go to court.
I don't mean to be rude by saying this, but it seems like this is a hard case to win.
My advice might not work for you but good luck anyway.

No real update yet, called to see how much it would be, but it hasnt been entered into the system yet. He only wrote down my licence number, but if the name was wrong would the court people correct that?
