Grinding (in STi 6MT - dealer refuses to cover under warranty)

grinding noises and transmission breakdown
I had a similar problem my sti and I am in a horrible place. The STI's gears grind in 4th and 6th at high revs. I took it in 3 months ago and they said nothing was wrong. Three months later the engine got stuck in 2nd and I had to tow it to the dealer. The subaru dealership looked at it and then sent the engine to NJ. After looking at the engine they stated this is my problem and not their fault.
They say that I was the cause of the problem and I need to pay for the damage. I have less than 3000 miles on the car and now have to pay 2000 for the synchoniser gear, gearbox, and the shift fork.
Any advice is appreciated because after 3 months I feel this is a bunch of crap that I am having these problems already.

Moved your post to Warranty forum since you've already gone past the diagnosis stage and had the dealer examine your car.
Look at the literature that came along with your Owner's Manual. You have the right to go over your dealer to the regional SOA (Subaru of America) structure to help resolve warranty and service problems and questions. It's not a guarantee that they will side with you but it is probably your next step. You could also take it to another dealership and get a second opinion.
