You need one of these bad boys:
AEM Cold Air Intake (06/07 WRX/STI Model) - PN 21-477P
What you have there is a 21-474, which fits 02-05. I bought a 21-474 before knowing this and the pipe inside the fender does not fit right. The 06-07 fenders have less space in them, causing the filter to be mashed against the body.

And it's legal for your 06.

^Thanks. It's funny how I didn't have a problem with mine fitting though. Everything fit perfectly and nothing was rubbing against anything or compressed by anything.
