Mike Smith was asleep Thursday afternoon, in the bedroom of his La Riviera Drive home, when the sound of metal grating on wood entered his dream. The sound jarred him awake. Fear jabbed at him: Someone had broken into his house.

He grabbed a .38-caliber Walther and his cell phone. He dialed 911 and stepped into a hallway. He saw the silhouette of a man through the blinds of his bedroom window. Then a woman walked into his foyer and looked at him with shock.

Before him was a heavyset woman with brown hair pulled into a ponytail. He'd never seen her before.

Smith locked eyes with her. As she stepped toward him, he cradled the phone against his shoulder, knelt on one knee, gripped the handgun with both hands and fired several times.

The woman ran outdoors. The man seen at the window fled.

In an instant, the burglary-gone-wrong became one of several in recent years that have been debilitating or deadly to burglar or resident.

"There's no doubt that committing burglary is extremely dangerous to get involved in, because you don't know if the homeowner is going to be home - or if the homeowner is going to be armed," Sacramento Police Sgt. Terrell Marshall said. "Homeowners are well within their rights to defend themselves."

Marshall said investigators are investigating whether Smith was justified in shooting.

Smith said the moment he saw the woman was the most frightening instant of his life. "I haven't slept since this happened," Smith said nearly 24 hours after the burglary. "Last time I went to sleep, I woke up with someone breaking into my house."

Smith, 37, a security consultant for a private investigator, said he was ill Thursday and sleeping with a fan cooling him and drowning out street noise.

He believes the woman slipped under the garage door of the home in the 8400 block of La Riviera Drive. She apparently then entered the home through a door that was chipped away near the deadbolt.

Because he believed he would be harmed, Smith said, he fired the handgun for the first time outside of a shooting range.

Sacramento police dispatchers had broadcast the woman's description to officers who rushed to the scene and detained her as she ran from Smith's house.

Marshall said she was treated for nonfatal injuries and was in stable condition. She has been arrested on suspicion of burglary, although her identity had not been confirmed.

The male burglary suspect remains at large, Marshall said.

"I think they were just as surprised to see the resident as he was to see them," Marshall said.

Other houses in the area show signs of attempted break-ins, Marshall said, but it hasn't been determined if the cases are related.

Five doors down from the house Smith rents, Mikhail Komarov said he arrived home to find his gate open and his side door bearing signs of an attempted break-in.

"We've never had problems," said Komarov, who moved to the street a year ago.

BURGLARY SHOOTINGS
California Department of Justice data show 13,000 burglaries were reported in Sacramento city and county in 2005. At least two went awry, according to officers at the time of the events:

* An 81-year-old Hagginwood man awoke in April to the sound of broken glass, then shot and wounded a man he saw crawling through the window.

* Arden Park stockbroker Dennis James Conrad in January went home during lunch, interrupted a burglary and was shot, apparently with his own handgun. James Schanrock,then 23, was later charged with murder.

In 2004, burglaries backfired for three burglars in two incidents:

* A south Sacramento business owner shot and killed two men who jumped into his son's Southeast Asian grocery store through heating ducts.

* A 53-year-old Rancho Cordova woman shot and wounded a parolee who crashed through her sliding glass door. The next day Carolyn Lisle commented, "I don't think he'll be back."
I think the Sacramento Police Department will find Smith justified in discharging a firearm to defend himself. There were at least two burglars and one had already entered his home. It's dangerous to try to talk a criminal into leaving your home peaceably, let alone two of them. Eventually they will try to take the weapon from the homeowner and then it's all over.

Definitely justified. If someone makes the decision to forcefully enter my property and attempt to steal/damage the stuff that I worked hard for, they should know that they risk getting capped.

I wish when Deede's apartment got burglarized I was there to bust some heads.

I've got some high base buck shot waiting for anyone that comes into my home uninvited. Seems like most of these things in the Sacramento area happen in broad daylight.

it wasn't justified at all! There were plenty alternatives he could've took. For example, I would have thrown a twinky at her

I think the guy needs to go back to the range and practice. He fired several shots at a heavyset woman (read big target that moves slow) and missed/slightly wounded her.

I like how they say, "heavy set with dark hair" leaving out any sort of accurate description. ie: White, black, hispanic, asian...

I've been listening to a scanner and often hear the race as part of a 'perps' description. Otherwise HTF are you supposed to know which person it is?

It's usually a three letter code though to be more efficient on the radio.

HMA = Hispanic male adult
WMJ = White male juvenile
